Court strikes out homosexuality charges against dancer, James Brown and others

The homosexuality charges that were filed against effeminate dancer, James Brown and 46 others in November of 2019, have been struck out by a federal court in Lagos.

Justice Rilwan Aikawa who ruled on the case on Tuesday October 27, struck out the case on ground of the charges against the defendants lacking “diligent prosecution” by the police.

While the federal high court judge pointed out that the prosecuting counsel, J.I Ebhoremen, was absent from court for the umpteenth time with no reasonable explanation, the defence counsel, Israel Usman noted that it was the ninth time Mr Ebhoremen didn’t show up in court since the case started in 2019.

Usman urged the Judge to strike out the case as Section 356(5) of the Administration of Criminal Justice Act, 2015 provided a maximum of five adjournments at the instance of the prosecution in a criminal trial.

He said;

“This is ninth adjournment at the instance of the prosecution in contravention of the statutory Act that regulates criminal justice system. We urge the court to dismiss the case and discharge the defendants.”

Ruling on the case, Aikawa said,

“I agree entirely with defendants’ counsel that the prosecution’s attitude to this case is not satisfactory. In my view, this should not be. If the prosecution has a cogent reason not to be in court, he should have communicated in writing to the court and copy the defence counsel.

“For whatever reason, the prosecution is no more capable or not willing to prosecute this case. Consequently, this case is struck out due to lack of diligent prosecution.”

Happy 20th Anniversary to us!!!

Time really flies!

It’s been 20 years???

Amazing!

I thank God for the years.

For the beauty of a relationship amidst all the fears.

The pain and sorrow and grace we’ve seen.

The journeys and places and levels we’ve been.

We don’t take it for granted that we got this far.

The children and blessings that show us God is truly extra.

We hurt, we cried, we live, we die.

We know and pray, for on God alone we rely.

It’s so easy to look back, forget, and think we made alone.

I’m grateful that we’re still a work that’s not yet done.

I wish you, my wife, many many more years together.

I certainly couldn’t have asked for someone better.

In a related news, Officials of the Ebonyi State Police Command have apprehended a couple, Philip and Agatha Iboko, for reportedly torturing their eight-year-old house help, Osinachi Iboko.

Agatha, who is a 26-year-old mother of one and is a serving Corp member with the ministry of Agriculture, Ebonyi State, and her husband Philip, were reported to have unleased terror and chained their house help for eating part of the N10 candy they bought for their two-year-old daughter.

The incident was recorded by a neighbour, who then shared it online. In the video, Osinachi was kept in the scorching sun with her legs and hands tied.

It later took the intervention of two of their neighbours, Mr Chinedu and Mr Raymond, to release her — the girl is now in the custody of the council Chairman of the Izzi LGA, Chief Paul Nwogha.
